We have significant experience representing clients who make charitable gifts. We regularly advise our clients on the proper planning, implementation and reporting of charitable gifts to obtain intended results, including the maximum tax benefits, for their charitable giving. We assist donors making charitable gifts of appreciated securities, cryptocurrency, and cash. In addition, we frequently provide counsel to our clients on gifts of closely held business interests, private equity, real estate, artwork, and other complex assets. We often work with our clients in drafting gift agreements, and addressing other issues associated with major gifts.

We regularly counsel our clients in the creation and funding of new charitable giving structures. These structures include: lifetime and testamentary charitable remainder trusts, lifetime and testamentary charitable lead trusts, gifts of a remainder interest to charity of a personal residence or farm, private foundations, donor advised funds, supporting organizations and other public charities.

We represent not-for-profit institutions, and provide advice to their planned giving and frontline fundraising staff and office of general counsel on organizational, tax and regulatory issues.

Our attorneys are available to draft gift agreements, pledge agreements, split-interest trusts and charitable gift annuities on behalf of charities. We consult on the tax and legal aspects of a particular gift during the proposal and planning process, with the institution and when requested, donors and their advisors.
