When a grantor dies or becomes incapacitated, the successor trustee takes legal control of trust assets and becomes responsible for carrying out the trust’s terms. Under Chapter 736 of the Florida Statutes (Florida’s Trust Code), that responsibility begins immediately and carries formal legal obligations.

Core Trustee Tasks During Administration

The trustee’s first tasks typically include notifying beneficiaries and other qualified parties, then identifying, inventorying, and valuing all trust assets.
