Florida trust litigation is governed primarily by the Florida Trust Code, Chapter 736 of the Florida Statutes. This chapter establishes the legal duties trustees must fulfill, the rights beneficiaries hold, and the remedies available when those duties are breached.

Beneficiary Remedies Under Florida Law

Florida Statute 736.1001 gives beneficiaries a broad range of remedies when a trustee fails to meet the standards imposed by the Trust Code. A court may compel the trustee to perform, order an accounting, suspend or remove the trustee, impose a constructive trust, reduce or deny trustee compensation, or impose surcharge damages for losses caused by the breach.

Trustees also carry an ongoing duty to keep qualified beneficiaries reasonably informed. Under Florida Statute 736.0813, a trustee of an irrevocable trust must provide annual accountings and, within 60 days of accepting a trust, must notify qualified beneficiaries of that acceptance. Failure to meet these obligations can be actionable.

Florida Statute 736.1008 imposes limitations periods on trust contest and breach claims. The deadline varies by claim type and by when the claimant knew or should have known of the breach.
